Why I Complained to CSOS
A personal account of unlawful debt collection practices
Let's get one thing straight. I don't owe anyone a cent on my property. My home is 100% paid up. My current levy account is also paid up.
My record of paying is sound and until the move from Residentia, there were no 'strikes' against me as such.
Enter the City Debt Collectors and their aggressive 'Strike' action.
I was thus amazed to be treated like a bonded servant by Trafalgar Property, our new managing agents, who seek to profit by jumping the gun on debt collections. An HOA is not a pure debt collecting machine and is rather a community of home-owners. The period of dispossession in which certain individuals lacked common law rights is long gone, in its place has arisen a culture of contempt for our Republic and its laws.
After querying the imposition of 'receipting fees' on my account with no basis in law, I received responses that were incoherent and illogical to say the least. Accordingly, I was informed that our HOA had appointed Trafalgar as debt collectors, and they were acting in that capacity. In addition I was told, there was now an 'automatic handover after 7 days' in place (our HOA constitution stipulates at least 30 days).
I proceeded to contest the receipting fees, requesting sight of the 'Handover resolution' and thus the underlying juristic basis for the fees. My position is that such fees would only be possible if my account was formerly handed over, and even then, such a category does not exist under the current Debt regulations.
What Transpired
What transpired could be considered a circus comedy, if the implications were not so dire. Trafalgar forwarded me documents from a totally different scheme called Solaris Place, with a completely different board.
When I pointed this out, they doubled-down, claiming, 'this is the correct scheme' and 'trustees change from time to time'.
On July 15, 2026 I received a letter of demand for the outstanding fees, and I proceeded to file two complaints before CSOS:
- The first deals with the receipting fees and failure to abide by the regulations on debt collection
- The second regarding the dissolution of the village water committee without notice and the imposition of a novel voting system in breach of the HOA constitution, which resulted in paper ballots being discarded, with digital voting rendering instantaneous results but spurious outcomes
I have filed an additional complaint before the Council of Debt Collectors regarding the improper and unlawful actions of Trafalgar. Their latest response to my first CSOS complaint is incoherent to say the least. It attaches a new resolution by the Board governing handovers (three months) seeking to implement the resolution retroactively whilst making out a case that I am somehow a recalcitrant debtor.
I am not here to oppose lawful fees, but rather the strange notion that anybody should deem fit to aggressively pursue my household on account of membership of an HOA, via a strategy which is essentially an abuse of the system. I also feel strongly about the rights of the most vulnerable in our community.
I therefore urge you all to read the associated campaign article and to consider the ramifications of the actions of the current board and managing agents.
Sincerely yours,
David Robert Lewis
